Terms and conditions

1. Overview

By accessing or using services from Connect and Serve, you agree to be legally bound by these Terms and Conditions.

3. Scope of Work

Upon commencement, a detailed project scope will be provided outlining the specific deliverables and functionality included in the chosen package. We aim to deliver initial website drafts within 10–15 business days from the time the onboarding document is submitted. Timely client communication and content delivery are essential for meeting deadlines. Delays in providing necessary content, branding, or approvals may result in a shift in the timeline. Any changes or additions beyond the agreed scope must be submitted in writing and will be quoted separately. Minor content edits or tweaks may be made at our discretion.

4. Client Responsibilities

Clients are required to submit all essential content and assets such as logos, text, and images in a timely manner to ensure project timelines are met. Upon purchase, clients will receive an onboarding document that must be completed before any development begins. This document captures business details, branding assets, and key content needed to build the website. Failure to complete the onboarding document may delay the project and could result in additional fees or eventual cancellation. Clients must also confirm they hold the appropriate rights to all materials provided. Timely responses to communications and access to relevant platforms such as domain registrars or hosting accounts are essential to avoid project disruption.

5. Design Compatibility

Websites are built to be responsive and compatible with the latest versions of major web browsers, including Chrome, Safari, Firefox, and Edge. Compatibility with outdated or uncommon browsers and devices is not guaranteed unless specifically requested and agreed upon in the project scope.

6. Third-Party Services & Licensing

We may integrate third-party tools, plugins, or licensed software into your website as needed. Costs related to premium plugins or licensed services are only covered when explicitly stated. Otherwise, the client will be responsible for the ongoing renewal and maintenance costs of these tools unless they are enrolled in a managed plan.

7. Hosting & Maintenance

Hosting is required to activate your website. All packages either require a hosting plan or include a defined hosting period. The Starter Package requires a hosting plan to be purchased separately. The Growth Package includes six months of free Standard Hosting (valued at $252), after which the plan renews at $42 per month. The Premium Package includes twelve months of free Pro Hosting + Maintenance (valued at $1,104), then rolls over into a $92 monthly plan. All plans renew automatically unless cancelled in writing at least fourteen days before the renewal date.

8. Intellectual Property & Portability

You own the rights to your website content and design upon full payment. A migration fee may apply if you request a transfer to another provider. Following cancellation, we will retain your website files and data for up to thirty days. After this period, all assets will be permanently deleted. Clients will be provided with editor access unless otherwise agreed. Full admin access may be granted upon request, with limitations in place to protect the integrity and security of the site. We may showcase your project in our portfolio.

9. Use of AI Tools

We may use AI tools for content inspiration or design layout assistance. Final deliverables are reviewed and refined by humans to ensure quality and relevance.

10. Limitation of Liability

We are not liable for any damages, outages, or loss of revenue caused by your website or hosting performance.

11. Indemnification

You agree to indemnify and hold us harmless from any claims related to your content, data, or use of our services.

12. Termination Rights

We reserve the right to terminate any service or project in the event of abuse, non-responsiveness, or a breach of these terms. Refunds will be handled in accordance with the refund policy outlined in this document.

13. Force Majeure

We are not liable for delays or non-performance caused by events beyond our control, such as natural disasters, server outages, or health emergencies.

14. Jurisdiction & Legal Governance

These terms are governed by the laws of Queensland, Australia. Any disputes will be handled within the legal jurisdiction of Queensland.

PRIVACY POLICY

1. What We Collect

We collect your contact information, business details relevant to your website, and user interaction data via cookies or third-party analytics services.

2. How We Use It

This data is used to provide and deliver your website, communicate with you, and handle invoicing and service improvements. We do not sell or share your personal data with any third parties.

3. Security

Your data is securely stored and access is restricted. While we follow best practices to protect your information, no online system is entirely risk-free.

REFUND & CANCELLATION POLICY

1. Refund Conditions

Clients may only request a refund during the development phase of the website project. Once the website has been approved by the client, either in writing or verbally, and marked as complete, no refunds will be issued. To be eligible for a refund during development, a fixed cancellation fee of $400 must be paid, along with the full annual hosting cost if hosting was included. Once those fees are cleared, any remaining balance will be refunded.

2. Non-Refundable Items

The following are non-refundable: paid hosting fees, third-party plugin or tool purchases, out-of-scope work, and any projects inactive for more than twenty-one days without client communication.

PACKAGE, HOSTING & MAINTENANCE POLICY

1. Mandatory Hosting

The Starter Package requires a hosting plan at the time of purchase. The Growth Package includes six months of free Standard Hosting and renews at $42 per month. The Premium Package includes twelve months of free Pro Hosting + Maintenance and renews at $92 per month.

2. Auto Rollover, Billing & Non-Payment

Hosting plans are billed monthly and payments are automatically debited from the provided account details. Clients will receive email notifications prior to any rollover period. If payment fails, the client will receive up to three reminder emails within a thirty-day grace period. Each reminder may include a $15 administrative fee. If the balance remains unpaid after thirty days, website access may be revoked and services suspended. If no payment is received after sixty days, all website files and associated content may be permanently deleted. Service reactivation will require full payment of the outstanding balance and a $500 reconnection fee.

3. Maintenance Access

Only clients on the Pro Hosting + Maintenance Plan or those enrolled in the Premium Website Package receive ongoing maintenance support. This includes one monthly update such as a text or image replacement. Larger changes including design modifications, additional pages, or development work are excluded from this plan and require a custom quote.
